Welcome to QKLOTHING.COM. These terms and conditions outline the rules and regulations for the use of our website and the manufacturing services we provide. By accessing this website and engaging our services, you accept these terms and conditions in full.

1. Definitions

"Client," "You," and "Your" refers to you, the person accessing this website and accepting the Company’s terms and conditions.
"The Company," "Ourselves," "We," "Our," and "Us" refers to QKLOTHING.
"Services" refers to the custom garment manufacturing services offered by QKLOTHING, including but not limited to sourcing, sampling, production, and logistics.

2. Quotes and Orders

All quotes provided by QKLOTHING are based on the information and specifications (tech packs, fabric requirements, quantity) provided by the Client. Quotes are valid for a period of 30 days unless otherwise stated. An order is considered confirmed only upon receipt of a signed purchase order and the required advance payment.

3. Sampling Process

We provide pre-production samples for approval before commencing bulk production. The cost of sampling will be included in the quote. While we strive for perfection, minor variations may occur. Bulk production will only begin after the Client provides written approval of the final sample. Any changes requested after sample approval may result in revised costs and extended lead times.

4. Payment Terms

Our standard payment terms require an advance payment of 50% of the total order value to confirm the order and begin production. The remaining 50% balance is due upon completion of the order and before shipment. We accept payments via bank transfer. All bank charges are the responsibility of the Client.

5. Production and Lead Times

Lead times are estimated and commence from the date of pre-production sample approval and receipt of the advance payment. Typical lead times are 45-90 days but may vary based on order complexity, material availability, and production capacity. We will not be liable for delays caused by circumstances beyond our reasonable control, such as shipping carrier delays, customs clearance, or force majeure events.

6. Shipping and Delivery

We offer global shipping via sea or air freight. Shipping costs are quoted separately and are the responsibility of the Client. All duties, taxes, and customs clearance fees in the destination country are the responsibility of the Client. Risk of loss or damage to the goods passes to the Client upon delivery to the carrier.

7. Quality Assurance

We adhere to a strict AQL (Acceptable Quality Limit) 2.5 quality standard. If any goods are found to be defective beyond this standard, the Client must notify us in writing within 14 days of receipt. Our liability will be limited to the repair, replacement, or credit of the defective goods at our discretion.

8. Intellectual Property

The Client warrants that they own or have the legal right to use all designs, logos, trademarks, and other intellectual property provided to us for production. The Client agrees to indemnify and hold QKLOTHING harmless against any claims of intellectual property infringement arising from the production of their designs.

9. Limitation of Liability

In no event shall QKLOTHING, nor any of its officers, directors, and employees, be liable to you for anything arising out of or in any way connected with your use of our Services, whether such liability is under contract, tort or otherwise, and QKLOTHING shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of our Services.

10. Governing Law & Jurisdiction

These Terms will be governed by and construed in accordance with the laws of Bangladesh, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Dhaka for the resolution of any disputes.
